Fr <br />JUL 10 1985 BOOK 61 m n 448 <br />developer in the future as the property around his project <br />develops so those people don't get a free ride. This is being <br />looked at by our consultants, and one of the things they are <br />looking at is a type of refundable advance agreement. Attorney <br />Brandenburg agreed this arrangement could be very involved and <br />would require careful accounting, but noted that it can beset <br />out in the ordinance up front so the developer knows just what <br />his rights will be. <br />Vice Chairman Scurlock brought up the possibility of a five <br />year limit and then no refunds.. He noted that we want developers <br />to build where the infrastructure is available to support their <br />project, and he did feel there must be some time limit. <br />Commissioner Bird agreed there should be some penalty for <br />building prematurely in an area, but then again everyone else <br />should not get a free ride. <br />Attorney Brandenburg pointed out that everyone else pays <br />impact fees as well, but they do not get any credits because they <br />did not contribute to the initial road. <br />Vice Chairman Scurlock advised that the Transportation <br />Planning Committee is still working on this and will come to the <br />Commission with a recommendation which he felt sure will be <br />heavily discussed. He noted that one of the other questions <br />raised was whether the public sector (the County, the School <br />District, the Hospital District, etc.) pays impact fees also. <br />Attorney Brandenburg reported that the consultants were told <br />to make a list of any proposed exemptions and bring this to the <br />Commission for a decision. He personally did not feel anyone <br />should be exempt, but felt there will be complaints from <br />non-profit groups, church groups, the City of Vero Beach, etc. <br />The Vice Chairman asked if anyone present wished to be <br />heard.
