present parking is inadequate, what will happen when you add a <br />new building and eliminate some of the existing on-site parking. <br />Mr. Hiers informed the Board that the only businesses on <br />this property are United Irrigation and Rogers Cushions, and they <br />do have a retail outlet in another area. Sunnyland Clearing only <br />has a telephone in the building. <br />Commissioner Bowman inquired about the difference in parking <br />requirements between retail sales and wholesale sales, and <br />Director Keating explained that wholesale is the same as <br />manufacturing - one space per 500 sq, ft. He reiterated that Mr. <br />Hiers does meet the requirements of the ordinance; he isn't <br />losing any parking but, in fact, is expanding and redesigning the <br />parking on his site, which staff feels is a better situation. <br />Vice Chairman Scurlock agreed this is a difficult and <br />unfortunate situation, and although it may be an incompatible <br />use, he did not see how, under our current law, we can deny Mr. <br />Hiers the expansion of a conforming use even though we may not <br />like what it looks like. We must act on what the law allows us <br />to do, and if Mr. Hiers has met all the criteria, on what basis <br />do we deny him' <br />Mr. Fleckenstein continued to argue overflow of parking, <br />noise pollution, parking of heavy equipment on the.site, the <br />appearance of a junk yard, etc. <br />Director Keating commented that staff had no indication <br />there was a noise problem, and in further discussion, it was <br />pointed out that the Code Enforcement Board addresses these type <br />problems and fines will be assessed if the situation is not <br />cleared up. However, the only issue before the Board today is <br />the site plan which is being appealed. <br />Mr. Fleckenstein then noted that Mr. Hiers dumped a tre- <br />mendous amount of land clearing material to the north of this <br />property. <br />Mr. Hiers stated that the Code Enforcement Board looked into <br />that, and Director Keating confirmed that there has been action <br />61 <br />JUL 10 1985 BOOK 473 <br />
