DREDGE & FILL PERMIT APPLICATION <br />FILE NUMBER 31-106240-4 <br />APPLICANT: Henry J. Muller c/o <br />Stephen E. Moler, P.E. <br />WATERWAY & LOCATION: The project is located adjacent to the <br />Indian River, 2000 feet north of Schuman Drive on U.S. Highway <br />#1 between Wabasso and Sebastian (River Run condominium pro- <br />ject) . <br />WORK & PURPOSE: The applicant proposes to construct 44 boat <br />slips, 19 finger piers and a gazebo in an existing excavated <br />lake adjacent to the Indian River. In addition, the applicant <br />proposes create a boat basin access channel on the upland <br />portion of his property to be connected to the existing boat <br />basin to the north of the property. The applicant proposes to <br />improve water interchange by constructing new submerged <br />wetlands on a portion of the upland property. <br />DESCRIPTION & CONDITIONS: <br />On June 11, 1985, the applicant received a D.E.R. permit to <br />construct the project and dredge an access channel from the <br />lake to the Indian River. <br />The portion of the Indian River within and surrounding the <br />original channel alignment supports beds of manatee grass, live <br />oyster rock and oyster shell - algal complex. If the channel <br />dredging is to proceed, these habitats will be adversely <br />affected through elimination or increased turbidity and <br />sedimentation. <br />On June 19, 1985, the County Commission considered a request to <br />appeal the permit through a D.E.R. administrative hearing. In <br />the discussion, the applicant and developer, Mr. Henry Muller, <br />stated that he would revise his project plans so that the river <br />resources would not be damaged. The specific proposal, which <br />is the subject of this application, involves connecting the <br />existing lake with the north basin; a proposal recommended <br />earlier by planning staff. <br />54 <br />
