He <br />continued that his client would like to study a number of DER <br />permits which have been issued in this area- which may be <br />overlapping and possibly conflicting. He, therefore, requested <br />that the Board not take any action until all the outstanding <br />permits have been reviewed. <br />Administrator Wright pointed out that if the Board takes no <br />action, the DER simply will move ahead. <br />Henry Muller, developer of River Run, stated that he under- <br />stood Attorney O'Haire's concern, but assured the Board that <br />there are no conflicting permits. He further noted that during <br />all the time this project has been underway, they have listened <br />very carefully to all of the input from all of the agencies and <br />have met with the people from the Audubon Society. There is no <br />problem. He felt the staff recommendation is fine, and noted <br />that actually the boat basin access channelv.s the-same,as <br />recommended by Mr. Challacombe earlier except for a little <br />different routing which the DER now is satisfied with. <br />Mr. Muller continued that he really was upset with the <br />attitude taken by some that they are trying to do something <br />detrimental to the river. He emphasized that the DER, the DNR <br />and the Corps all feel that what they are doing now is exactly <br />the right thing to do and that it will be beneficial - the <br />plantings going in are all delineated. Mr. Muller believed that <br />the permits Attorney O'Haire is referring to are the dredge and <br />fill permits which they had from the beginning for the buildings <br />that were on the water. These permits still exist and for the <br />same purpose, and they include the requirement that they must <br />replant the waterside as recommended by the DER. Mr. Muller <br />stressed that they are 100% on the side of all the people <br />concerned with the environment, and he felt it would be unfair of <br />the Board to withhold a positive comment. <br />Commissioner Bowman pointed out that the recommendation of <br />our Environmental Planner does not take into account the water <br />57 <br />JUL 724 1985 BOOK 61 PAGE 7®2 <br />
