T0: The Honorable Members DATE: July 17, 1985 FILE: <br />of the Board of County <br />Commissioners <br />DIVISION HEAD CONCURRENCE: <br />t <br />SUBJECT. <br />Robert &V Keats g, IVCp <br />RELEASE OF EASEMENT REQUEST <br />BY JIM HARRIS, SUBJECT PRO- <br />PERTY: LOTS 6 & 7, BLOCK 3, <br />ROSELAND GARDENS SUBDIVI- <br />SION <br />-Planning & Development Director <br />FROM: Betty Das REFERENCES: R/E Harris <br />Code Enforcement Officer DIS:REMS <br />It is requested -that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of July 24, 1985. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by Jim Harris, owner of the <br />subject property, for release of the side lot 5 foot easement <br />of Lots 6 & 7, Block 3, Roseland Gardens Subdivision. The <br />subject easements being described as the southeasterly 5 feet <br />of Lot 6, Block 3, Roseland Gardens Subdivision and .,the <br />northwesterly 5 feet of Lot 7, Block 3, Roseland Gardens <br />Subdivision. These lots are approximately 82 feet in width and <br />125 feet in depth. It is Mr. Harris's intention to consolidate <br />the lots into one large building site meeting the criteria of <br />the RM -6 zoning district and construct a duplex on the site. <br />The current zoning classification is RM -6, Multiple Family <br />Residential District. The land use designation is LD -2, Medium <br />Density Residential, up to 6 units per acre. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by Southern Bell, Florida Power & <br />Light Company, Jones Intercable, and the Utility and <br />Right-of-way Departments. Based upon their review, there were <br />no objections to release of the easements. The zoning staff <br />analysis, which included a site visit, showed -that drainage <br />would be adequately handled on-site. <br />RECOMMENDATION: <br />Staff- recommends to the Board, through adoption of a <br />resolution, the release of the side lot 5 foot easement of Lots <br />6 & 7, Block 3, 'Roseland Gardens Subdivision, being the <br />southeasterly 5 feet of Lot 6, Block 3, Roseland Gardens <br />Subdivision and the northwesterly 5 feet of Lot 7, Block 3, <br />Roseland Gardens Subdivision. as described in Record Book 0701, <br />Page 2348 of the Public Records of Indian River County, <br />Florida. <br />13 <br />J 6 BOOK 1 N�U'E.��� <br />
