J U L '2, 4 1995 <br />**ORDINANCE NO. 85- ** <br />BOOP( 61 PACE 6?7 <br />SECTION 3 <br />A new Section 18(A).2, entitled "CN: Neighborhood Commercial District", is <br />hereby adopted and shall read as follows: <br />SECTION 18(A).2 CN: NEIGHBORHOOD COMMERCIAL DISTRICT <br />A. Purpose and Intent <br />The CN Neighborhood Commercial District is established to implement the <br />Indian River County Comprehensive Plan policies for managing neighborhood <br />and tourist commercial nodes, and to provide areas for the development of <br />highly restricted commercial activities to serve primarily the residents of <br />the immediate area. The CN district is further intended to limit the <br />intensity of commercial activities in order to ensure compatibility with <br />nearby residential uses. <br />B. Establishment of Neighborhood Commercial Nodes <br />As provided in the Indian River County Comprehensive Plan, neighborhood <br />commercial nodes may be created by the Board of County Commissioners <br />pursuant to the provisions of this section. <br />1. Request for Node Establishment <br />Requests for the establishment of neighborhood commercial node may be <br />-made by motion of the Board of County Commissioners, the motion of the <br />Indian River Planning and Zoning Commission or the petition of a <br />"property owner.or the owner's -.agent. <br />2. Application and Fee <br />3. <br />4. <br />5. <br />All applications for the establishment of a neighborhood commercial <br />node shall be in a form approved by the Division of Planning and <br />Development and shall include a fee to be determined by the Board of <br />County Commissioners. All applications for node establishment shall <br />be accompanied by an application for rezoning to Neighborhood Commer- <br />cial (CN) which meets all of the requirements of Section 27 (A) of <br />this code. <br />Review Procedures <br />Applications for the creation of a neighborhood commercial node node <br />shall be reviewed pursuant to the provisions of Section 27 (A), except <br />as otherwise provided herein. Said review shall be done concurrently <br />with the review of the rezoning application. The rezoning to Neigh- <br />borhood Commercial (CN) shall be granted upon the approval of a <br />neighborhood node by the County Commission. <br />Approval by the County Commission <br />All applications for the establishment of neighborhood commercial node <br />shall require the approval of the majority of the entire Board of <br />County Commissioners. - <br />Standards for Neighborhood Commercial Node Establishment <br />The establishment of all neighborhood commercial nodes shall be <br />subject to the following standards. <br />a. Maximum Land Area. <br />Neighborhood nodes shall consist <br />range from zero (0) to three (3) <br />node may exceed three (3) acres. <br />b.
