- **ORDIN. 85- ** - <br />No neighborhood node shall be within one (1) mile of any existing <br />neighborhood node, commercial node, commercial/industrial node, <br />tourist/commercial node, hospital/commercial node, MXD district <br />or commercial corridor. All nodes shall be located adjacent to <br />an arterial, collector or subdivision feeder road. <br />All distances from existing nodes shall be measured using the <br />most direct route along roadways from boundary line to boundary <br />line and shall be applicable to properties on both sides of the <br />roadway. The Director of Planning and Development may reduce the <br />one mile separation requirement up to ten (10) percent, or 528 <br />feet, upon demonstration by the applicant that such a reduction <br />is warranted by specific characteristics of the proposed site. <br />Such characteristics shall include the following: <br />i. The proposed node is located within an area having a land <br />use designation of LD -2 or a higher density. <br />ii. The level of service on all streets providing direct and <br />indirect service to the proposed node will not be downgrad- <br />ed. <br />iii. The creation of the node shall not increase the potential <br />for strip commercial development. <br />iv. The residential character of the surrounding area shall not <br />be negatively impacted. <br />C. Compatibility with Surrounding Development <br />All neighborhood nodes shall be compatible with the surrounding <br />land uses. All commercial land uses shall be subject to minimum <br />separation from residential districts pursuant to the provisions <br />of the Neighborhood Commercial (CN) zoning district. <br />d. Limited Access. <br />No neighborhood node shall contain more than one point of direct <br />access to an arterial or collector roadway. Neighborhood nodes <br />shall utilize an existing marginal road system or provide for a <br />frontage road system meeting the requirements of Section 23.3 <br />(D)(10)(d). <br />e. Allowable Uses. <br />Uses within a neighborhood node shall be determined by the <br />Neighborhood Commercial (CN) zoning district. <br />f. Termination of Neighborhood Node Approval. <br />All neighborhood node approvals shall terminate and become null <br />and void if construction has not commenced, as defined in Sec. <br />23.1(G)(1), within eighteen (18) months of the date of approval. <br />In addition, neighborhood node approval shall be terminated upon <br />abandonment of construction, as defined in Section 23.1(G)(3). <br />C. Permitted Uses <br />In the CN, Neighborhood Commercial District, no building or structure shall <br />be erected, altered or used, except for one or more of the following. <br />Outdoor storage shall be prohibited within the CN district. Site plan <br />review shall be required for all uses, pursuant to the provisions of <br />Section 23. <br />I.
