AUG 211985 <br />BOOK <br />61 F,q F 858 <br />he understood that <br />the development has been sold since <br />site plan <br />approval. <br />Administrator Wright advised that the only reason staff is <br />recommending this change is that it was a change for the County's <br />benefit and in the long run it will save us money. <br />Vice Chairman Scurlock asked if the engineering, sufficient <br />just for the turning lanes, could have been completed in time, <br />and Director Davis felt it could have. <br />Dennis Spilotros, Senior Vice President of Shopping Center <br />Development Company of America, assured the Board that all <br />on-site improvements will be 100% completed, and all they are <br />looking for is the opportunity to meet their lease commitment <br />with Publix and Walgreens and get the center delivered in a <br />timely fashion. Their sales contract has a basic penalty clause <br />in it for late delivery, but the critical point is meeting their <br />lease obligation with Publix and Walgreens as without them they <br />don't have a shopping center. <br />Commissioner Bird asked Director Davis when the road <br />improvements actually would be in place. <br />Director Davis stated that basically the engineering is <br />about finished; we need some changes to utilities and some <br />utility poles have to be moved, DOT permits obtained, etc. Staff <br />is recommending the developer's engineer fast track some of these <br />items, including some signalization work which staff feels is <br />critical to widening Kings Highway. Director Davis stated that <br />basically it can all begin as soon as the DOT permit is acquired <br />which could be 30-60 days. <br />Vice Chairman Scurlock did not feel staff should tie them- <br />selves to such a timeframe considering all the outside agencies <br />involved; he believed it could take as much as six months, and <br />the Administrator agreed we could only state completion <br />contingent on outside agencies. <br />Commissioner Bird wished to ascertain if in the meantime <br />those two stores will open and use Kings Highway and SR -60 as <br />M - <br />
