SEP 4 1985 <br />9 <br />BOOK PA.Cr 9:J� <br />Director Dean emphasized that we do not seem to be able to <br />get together with this company on scheduling these services, and <br />they do not show up for appointments. He, therefore, did not <br />believe they have lived up to their contract. Director Dean <br />further noted that we presently owe them some money, and he would <br />like to see us cancel the contract because they have not provided <br />the services agreed to. <br />Chairman Lyons noted that the backup material indicates <br />there was a Fong delay between when we called them and the time <br />when items were actually repaired. <br />Director Dean stated that he did not feel we need another <br />contract for this maintenance but that it can be handled on an <br />as -need basis and save money. <br />MOTION WAS MADE by Commissioner Scurlock, SECONDED <br />by Commissioner Wodtke, to accept staff's recommenda- <br />tion and authorize cancellation of our contract with <br />Dave's Communications of Fort Pierce. <br />Commissioner Wodtke questioned paying the money owed; <br />whether we might be entitled to any damages; and whether we <br />should authorize any legal action -to recoup for lost services. <br />Assistant County Attorney Wilson did not feel it would be <br />appropriate to try to collect damages and stated he would just <br />like to cancel this contract immediately and not pay anything <br />further on it. He explained that we always have had a right to <br />cancel with 30 days' notice, and all he is doing here is avoiding <br />the thirty day notice because they haven't lived up to contract. <br />In discussion, it was noted that no one was present <br />representing Dave's Communications. <br />Commissioner Wodtke stressed he would not like to send a <br />signal to anyone with whom we have a contract, that if they do <br />not provide service, we will simply cancel and not ask for <br />damages. <br />26 <br />
