DESCRIPTION AND CONDITIONS <br />BOOK <br />In November of 1984, the Planning and Zoning Commission ap- <br />proved, with a condition, the site plan application submitted by <br />Mr. Bill Law to construct a 3,200 square foot contractor's <br />warehouse facility. The project site is an acre of land lying <br />between U.S. Highway 1 and Old Dixie Highway, immediately south <br />of White Aluminum Products in Winter Beach. The application <br />was approved with the condition that the site plan be amended to <br />depict access from Old Dixie Highway only. <br />Subsequently, a revised site plan application was submitted that <br />depicted the western portion of the property, which fronts on <br />Old Dixie Highway, as land excluded from the project site. <br />Furthermore, Mr. Law submitted a revised warranty deed which <br />conveyed the western portion of the original parcel to Econoway, <br />Inc., a Florida Corporation. The conveyance was intended to <br />represent that Mr. Law no longer has title to the subject <br />property. However, a check with the Secretary of State, Divi- <br />sion of Corporate Records reveals that the directors and offi- <br />cers of Econoway, Inc. are as follows: <br />President - B.C. Law <br />Director - Wanda Law <br />Vice President - Charles Phillips <br />s <br />Based on this information, it was determined that Mr. Law still <br />maintains control over the entire project site and that con- <br />nection to Old Dixie Highway has not been precluded by the title <br />transfer. <br />Therefore, on May 9, 1985, the Planning and Zoning Commission <br />denied the site plan application to construct 'a 3,200 sq. ft. <br />contractor's warehouse facility at 5875 U. S. Highway 1. <br />It is the denial of this site plan application that Mr. Law is <br />appealing. <br />ANALYSIS <br />A single point, of access to the project has been proposed via <br />the U. S. Highway 1 frontage. However, due to the fact that the <br />subject property also fronts on Old Dixie Highway, the Director <br />of Public Works recommended that access to the facility be <br />limited to this secondary collector. The basis for this rec- <br />ommendation is a policy set forth by the Comprehensive Plan, <br />which states: <br />Marginal access roads should be provided as part <br />of developments located along arterial and primary <br />collectors. Points of access to marginal access <br />roads should be spaced at approximate quarter mile <br />intervals. <br />The Functional Road Classification Summary found on page 80 of <br />the Comprehensive Plan, clearly states that access to U.S. <br />Highway #1 should be well controlled and limited to collector <br />roadways and major traffic generators. Specifically, access to <br />industrial type land uses would be limited to regional indus- <br />trial parks or complexes. The proposed development does not <br />fall within this category as it is anticipated that the project <br />will attract approximately 16 trips per day. <br />44 <br />Mt <br />
