OCT 2 1985 <br />BOOK 62 PAGE 33) <br />Commissioner Scurlock inquired how many trees were located <br />in the buildable area, and Planner DeBlois stated that two were <br />in the setbacks and two in the net buildable area. <br />Director Keating pointed out that being in the net buildable' <br />area does not mean trees can be removed automatically. That is <br />why we require a tree survey. <br />Harry Righton, owner of the lot, came before the Board and <br />stated his case, as follows: <br />The Board of County Commissioners <br />Indian River County, Florida <br />I own one vacant lot which is 50 feet by 100 feet and is located behind a small commercial <br />building on Oslo Road and 11th Drive. I had this lot cleared for security purposes, not <br />knowing a permit was required and I am now asking that a fine not be levied. I wish to <br />apologize and I am sorry for doing this. If I had known, I would have gotten a permit. <br />Since I have owned this building, it has been broken into several times. The water pump <br />has been stolen, arson which burned 1/3 of the building, and vehicles broken into. <br />Problems with security exist with other buildings in the area as you can see from these <br />pictures. <br />There are three lots behind my building that were cleared. I figured security would <br />increase if I cleared my small 50 foot by 100 foot lot, leaving the back of the building <br />clear. In this way there would be no place for -someone to hide or dump their garbage. <br />Also, when these lots were cleared a large pine tree on the northeast corner was partially <br />uprooted, where a strong breeze would cause the tree to fall and cause damage if someone <br />were to build on one of the cleared lots. Since I had the tree problem, garbage dump <br />problem, and security problem, I asked Mike to clear the lot, not knowing a permit was <br />4 <br />needed. I later learned a law existed and a fine could be levied." <br />I am asking YOU to work out a solution so Mike and I won't be fined. I strongly believe <br />in our community and work with many of it's organizations* giving my time and energy in <br />making Indian River County a better place to live. I would like to continue to help our <br />community and at the same time not deprive my family from the judgement I made in clearing <br />the lot. <br />• 44 <br />
