be his recommendation to face it, do it, and in the long run he <br />felt Mr. Metz would be better off and the property would be worth <br />more. <br />Chairman Lyons opened the Public Hearing and asked if anyone <br />wished to be heard. <br />County Attorney Vitunac advised that the Subdivision <br />Ordinance requires that certain findings be made before the <br />subdivision variance can be granted and it was his opinion that <br />Mr. Metz did not meet those requirements in the reasons given on <br />his application. <br />Chairman Lyons understood that there were really no grounds <br />stated that would enable this Commission to make an exception, <br />and Attorney Vitunac stated that was correct. <br />Mr. Metz pointed out that when they first presented this <br />plan, one of the main criteria was that they give 50 feet of <br />right-of-way on 37th Street and he wanted it made part of the <br />record that at this time they were willing to give the 50 feet. <br />Chairman Lyons explained that, in any case, Mr. Metz does <br />not meet the requirements on the application for an appeal for <br />exemption and the Board is not in a position to grant an appeal. <br />ON MOTION by Commissioner Wodtke, SECONDED by <br />Commissioner Bowman, Commissioner Scurlock being <br />absent, the Board unanimously (4-0) closed the <br />Public Hearing. <br />MOTION WAS MADE by Commissioner Bowman, SECONDED by <br />Commissioner Bird, that the Board deny the request <br />by Mr. Metz for a waiver of the requirements of the <br />Subdivision Ordinance on the.basis that the Board does <br />not have any legal right to grant an exemption. <br />Commissioner Bird explained that he seconded the Motion with <br />great reluctance and wished there was some way to find a unique <br />17 <br />BOOK 62 PAGE 37 <br />0 CT 9 1985 <br />
