Craver REFERENCES: <br />Staff Planner <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of October 23, 1985. <br />DESCRIPTION AND CONDITIONS <br />On September 12, 1985, the Planning and Zoning Commission <br />conditionally approved a major site plan application submitted <br />by Christopher Ekonomou. Approval was granted to construct a <br />1,200 square foot warehouse on the west side of 11th Court, <br />S.W., north of Oslo Road. Due to the fact that 11th Court, S.W. <br />is an unpaved road, approval was given with the condition that <br />the applicant pave the road, from Oslo Road to his north <br />property line, a distance of 250 feet. <br />It is the condition of site plan approval which Mr. Ekonomou is <br />appealing at this time. <br />ANALYSIS <br />During the past year, the Planning and Development Division has <br />received several applications for development of properties <br />within Oslo Park Subdivision. Mr. Ekonomou's approved <br />application is for construction on lot 19, block B, Oslo Park. <br />As all streets within the non-residential portion of Oslo Park <br />are unpaved, the Technical Review Committee has required that <br />all applicants escrow 37J% of the cost of paving their <br />frontages, prior to the issuance of certificates of occupancy. <br />In cases where the properties have been within 200 to 300 feet <br />from Oslo Road, the nearest paved road, the Technical Review <br />Committee has recommended that the applicants pave from Oslo <br />Road to their north property lines. In both situations, the <br />Planning and Zoning Commission has consistently upheld the <br />recommendations of the Technical Review Committee. <br />Since receiving site plan approval for lot 19, Mr. Ekonomou has <br />submitted an application for development of lot 20, which lies <br />immediately south of lot 19. Again, the Technical Review <br />Committee informed the applicant he would be responsible for <br />paving 11th Court, S.W. from Oslo Road to his north property <br />line. Due to other inadequacies of the site plan, the <br />application has not yet been taken before the Planning and <br />Zoning Commission. <br />It was the position of the Technical Review Committee that <br />because Mr. Ekonomou is developing 2 lots within 120 feet of <br />Oslo Road, he should be required to pave rather than escrow <br />funds. The Planning and Zoning Commission was informed of the <br />proximity of lot 19 to Oslo Road and concurred with the <br />Technical Review Committee. The Planning and Zoning Commission <br />was not aware at the time they granted conditional site plan <br />approval that Mr. Ekonomou planned to develop property nearer to <br />Oslo Road, specifically lot 20. <br />36 <br />i <br />
