Commissioner Scurlock wished to have it clarified just how <br />this will operate - he assumed that Mr. Galanis and his <br />department would cite an individual, and at that point that case <br />would be brought to Dr. Tucker and the Administrator; then the <br />Administrator would approve whether it would proceed to the next <br />step which would be the Enforcement Board. If a determination <br />was made jointly not to proceed with the next step, he assumed <br />the procedure would stop at that point, but he wished to know <br />what the appeal procedure would be if there were a split <br />decision. <br />Chairman Lyons felt if either Dr. Tucker or the Administra- <br />tor wants to continue, it should continue. <br />Attorney Vitunac noted that this is an alternative method of <br />enforcing these laws, and the Health Department still can go to <br />Circuit Court. <br />Commissioner Scurlock asked about having the appeal go <br />directly to the Commission. <br />Administrator Wright was not sure that the Board would want <br />to get into that, but Chairman Lyons felt the Commission might <br />want to. <br />Commissioner Scurlock suggested a Motion to table, but <br />Commissioner Bowman desired further discussion. <br />Commissioner Bowman noted that there still are two <br />appointments or more to be made and asked if the Board members <br />were in receipt of a resume from Dr. John Orcutt. <br />Commissioner Wodtke reported that he had several names to <br />submit also. <br />Commissioner Scurlock continued to discuss procedure and <br />where we go other than Circuit Court. He.did not want the <br />Administrator to have to go to Circuit Court every time there is <br />a problem. <br />Commissioner Bird suggested that we go ahead and set up the <br />Board and then work out the details of the procedure to be <br />followed. <br />7 <br />BOOK ...62 PAGE 456 <br />
