_ M M <br />is one of equity: the landowners on one side of a roadway must <br />dedicate substantial amounts of land for right-of-way, while <br />landowners on the other side have no responsibility for <br />dedicating right-of-way. <br />ALTERNATIVES AND ANALYSIS: <br />Alternatives for Satisfvina Riaht-of-wav Needs <br />The alternative policies described herein are possible means of <br />achieving the following objectives: <br />1) Implementation of the Thoroughfare Plan, thereby adequately <br />providing for planned growth as mandated and outlined in <br />the Comprehensive Plan. <br />2) Coordination with Drainage District plans, as part of the <br />County's inter -governmental coordination policy and in <br />recognition of the long-standing public purposes of the <br />Drainage District. <br />3) Effective timing of dedication and acquisition, wherein <br />rights-of-way are dedicated and acquired prior to allowing <br />construction that may later impede right-of-way <br />acquisition, and prior to increases in land value. <br />4) Utilization of existing rights-of-way and facilities, to <br />ensure the use of what has already been dedicated and <br />acquired and to continue the existing pattern of <br />right-of-way alignment. <br />5) Expansion costs to be borne mostly by new development, <br />ensuring that the County's policy of having new development <br />"pay for itself" is implemented. <br />Facilitation of. cost-effective improvements, whereby less <br />expensive methods of construction can be used, such as <br />utilization of swale drainage. <br />7) Equitable distribution of the dedication/acquisition burden <br />among property owners, to ensure that the costs and <br />benefits of public dedications and improvements are <br />balanced between property owners on both sides of the <br />thoroughfare. <br />A. Policies Using Present Right -of -Way Alignment Policy <br />ALTERNATIVE #1 <br />Continue the present policy of acquiring all additional <br />right-of-way from the side opposite the canal, via <br />dedication to the County' -at the time of development <br />approval. For projects requiring site plan approval, the <br />right-of-way is dedicated via the recording of a deed prior <br />to the issuance of a C.O. for the project. For <br />subdivisions, the right-of-way portion to be dedicated is <br />described and shown on the plat, becoming effective upon <br />the recordation of the plat. <br />ALTERNATIVE #2 <br />Continue the present policy of acquiring all <br />additional right-of-way from the side opposite the canal <br />and compensate the land owner for substantial <br />dedications. Credit towards traffic impact fees, if <br />adopted, would be the source of compensation. Thus, the <br />County would continue its present alignment policy, taking <br />advantage of all the previous dedications made under the <br />present policy, but would mitigate equity and fairness <br />problems by compensating developers dedicating "an extra <br />share" of right-of-way. <br />13 <br />OCT 311985BooK 62 Fr��F 5"` <br />
