BOOK 62 FAGF594 <br />allow the designer of a single-family home to come up with a <br />system which is compatible for the area. <br />Commissioner Bird did not want it to be too broad and <br />give a gray area so that when someone comes in they find <br />they have to reinvent the wheel. He emphasized that we need <br />to have some guidelines or structure so that people have <br />some idea of how to design their drainage system and won't <br />have to run out and hire an architect or engineer. <br />Director Davis advised that in some areas like Oslo <br />Park we could go in and establish a lot grading plan and <br />that would be on record so that anyone who builds in that <br />subdivision has to conform to the plan. They considered <br />doing that in Rivera Estates; however, there are hundreds of <br />other small subdivisions that have to be considered in some <br />way. <br />Chairman Lyons felt it almost has to be that broad in <br />order to cover homes in all the subdivisions. <br />The Board agreed to Commissioner Bird's suggested <br />rewording of Section 25.S, which is as follows: "No <br />stormwater discharge from impervious surfaces on <br />single-family lots to abutting property shall be allowed." <br />Attorney Vitunac believed we would have a problem with <br />the suggested change as there is a law already in force <br />which prohibits alteration of the natural flow of water to <br />increase the water on your neighbor's property. Therefore, <br />if we say that it is illegal to increase the runoff from <br />impervious surfaces, we would not have as much protection as <br />there is now through the common law, which is enforced <br />through civil action between the two neighbors. <br />Mr. Galanis felt that what Director Keating wants to do <br />is just be able to review the situation and make some <br />recommendations for requirements. <br />Director Keating understood that Attorney Vitunac is <br />saying that eliminating the first sentence in 25.S would be <br />8 <br />i r � <br />
