NOV 2 019$5. <br />BOOK 62 FnF 78O <br />The proposed CH zoning is consistent with the existing C-2 zoning <br />located north and east of the subject property and is in <br />conformance with the MXD land use designation. While the <br />proposed CH zoning is not generally consistent with the LD -1 land <br />use designation, staff feels that special conditions exist which <br />would allow all of the subject property to be rezoned to CH. The <br />Ven -Mar property extends 798 feet south of Oslo Road with the.. <br />north 600 feet being zoned C-2 and the south 198 feet zoned RS -3. <br />Because the south 198 feet is being used for part of Ven -Mar's <br />business, it seems more reasonable to establish the Heavy Commer- <br />cial zoning district boundary along Ven -Mar's south property line <br />rather than •transecting the property. There is a policy in the <br />Comprehensive Plan which provides for this situation which <br />states: <br />Certain parcels of land which do not conform to the <br />policies for nodal development, but can be <br />demonstrated to be suitable for commercial or <br />industrial development and otherwise meet the <br />performance standards described in this element, <br />may receive consideration by the Board of County <br />Commissioners for commercial or industrial zoning <br />classification. <br />Staff feels that this provision of the Plan applies to the <br />subject property. <br />Transportation System <br />The subject property has direct access to Oslo Road (classified <br />as an arterial street on the Thoroughfare Plan). The maximum <br />development of the subject property could attract up to 229 <br />average annual daily trips. <br />Environment <br />The subject property is not designated as environmentally sensi- <br />tive nor is it in a flood -prone area. <br />Utilities <br />County water is.available. County wastewater facilities are not <br />available. <br />RECOMMENDATION <br />Based on the above analysis, including the Planning and Zoning <br />Commission's recommendation, staff recommends approval. <br />4 <br />Planner Shearer advised that since the property is split <br />with the majority already zoned commercial and a commercial use, <br />staff feels the rezoning should be approved. <br />Commissioner Bowman asked about residential in the RS -3 <br />area, and Planner Shearer stated that it is undeveloped; there is <br />no residential adjacent. <br />Attorney Chris Marine came before the Board representing <br />Ven -Mar. He felt staff has pretty well covered the situation and <br />noted he would be glad to answer any questions. <br />22 <br />
