E2 <br />FAU" 9 L <br />was his <br />impression they were still working together, <br />and he <br />emphasized that they had no intention -of breaking off their talks <br />with the Kromhouts as they look at this as a key part of their <br />drainage situation. <br />Commissioner Wodtke asked the Kromhouts if there is any <br />discrepancy between them and the Drainage District as to whether <br />they have rights to drain within the District, and Lex Kromhout <br />noted that by saying nothing, the District leaves questions. <br />Their rules, however, say that if you were in existence before <br />173, which the Kromhouts were, you would be grandfathered in, and <br />they have advised the District of this. At the present time, the <br />situation is in limbo. <br />Chairman Lyons asked if they do drain through there now, and <br />Mr. Kromhout confirmed that they do. <br />Commissioner Wodtke felt there is another issue involved <br />other than just the draining of the Cain and Corrigan properties. <br />He kind of read that when the District asked for that 320 acres, <br />it was to give them the right to drain their property, which <br />actually is a separate issue. <br />Lex Kromhout confirmed that is, in effect, what the District <br />said. Mr. Kromhout continued that it seems there is a misunder- <br />standing about the whole drainage situation as they still stand <br />ready to help their neighbors. Re their problem with St. Johns, <br />he believed that may come down to a court fight. <br />Chairman Lyons felt if that happens, the county may be <br />involved in the fight also as there are many thousands of acres <br />of County land that would be affected. <br />Lex Kromhout agreed and noted that while there is about 4600 <br />acres directly involved, there is a potential for all the prop- <br />erty west of 1-95 between CR 512 and SR 60 to become involved. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously closed <br />the public hearing. -- <br />52 <br />W <br />
