M M M <br />Attorney Vitunac recommended that we call the bond before <br />the deadline of December 15th. He reported that Assistant County <br />Attorney Jim Wilson notified the bank in Texas of our intentions <br />to call the bond and they contacted Florida Land, who finally <br />responded to us and said they would get another bond in here. We <br />called them several weeks ago, but they have not returned our <br />calls. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously authorized <br />the County Attorney to call in the $20,000 bond placed <br />by Florida Land Company for the stabilization of Jungle <br />Trail. <br />P. Orchid Isle Park Property <br />Assistant County Attorney Jim Wilson explained that we have <br />an opportunity to trade a small neighborhood park in Orchid Isle <br />for a larger piece of property near Kiwanis-Ibbart Park. All of <br />the property owners must sign a quit -claim deed in order to give <br />the County undisputed claim to the neighborhood park and allow us <br />to get title insurance. Without title insurance, this property <br />is basically worthless. All but 'two of the property owners have <br />signed, but it is hoped that they are on the verge of coming <br />around. Attorney Wilson reported that he is in the process of <br />drafting a letter asking them a final time to contact us so that <br />we can try and work this out. If they refuse to sign the <br />quit -claim deed, the only other alternative would be to file an <br />action for quiet title to determine our rights to the property. <br />He requested permission to file the action in 30 days. <br />Commissioner Bird explained that originally there were three <br />small pieces there, but this particular one is a buildable sized <br />lot. The Commission decided that two pieces were expendable, as <br />far as public parks were concerned, and we donated the two <br />smallest pieces to the Orchid Island Property Owners Association <br />25a <br />d E C 111985 UP411' PAGE <br />
