DEC 119 5 BOOK 62 RGE 9'72j <br />Chairman Lyons noted that there is no backup on this and did <br />not understand how this came before the Board without going <br />through the regular channels. <br />Administrator Wright explained that this public hearing had <br />been properly advertised and paid for by the developer. He <br />admitted there was a breakdown in getting the backup material to <br />the Board, but the only real change from the September 25th <br />meeting of the Board of County Commissioners is in the map <br />showing the property owners who are in favor of the paving. It <br />is the same issue, but the developer is asking the Board to <br />reconsider. <br />James Lawhon, developer of Oslo Ridge, recalled that the <br />petition for paving 11th Lane S.W. was turned down at the Public <br />Hearing of September 25, 1985 because not enough people signed <br />the petition. The people that were against it have built their <br />homes facing the other street on a through lot and they do not <br />feel they should pay the cost for paving the street in the back <br />of their lots. He stated he is willing to pay the paving costs <br />of the people in those 4 houses in order to get enough people to <br />sign the petition and felt that would be fair enough. <br />Chairman Lyons opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. <br />Audrey McCleary noted that Mr. Lawhon did not offer to pay <br />for her portion of the paving which is approximately $800. She <br />explained that she owns lots 7 and 8 on the block between <br />Fairview Road North and 4th Ave. S.W. Every house on 12th Street <br />S.W. between 11th lane and 12th Street faces 12th Street S.W. <br />Mrs. McCleary found it rather strange that the proposed paving <br />stops in the middle of one of their lots. <br />Chairman Lyons explained that the petition is for paving the <br />road that fronts the developer's property. <br />Mrs. McCleary did not understand why they have to bear the <br />burden of paving when it does not benefit their property in any <br />way; all the garages face 12th Street and they don't use 11th <br />40 <br />
