The principal advantage of mediation is the ability to explore avenues of <br />settlement in a supportive setting without the cumbersome court entangle- <br />ments. Mediation stresses negotiation and the earliest possible conclusion <br />to the dispute. Further, the mediator is free to consider the relation- <br />ships between the parties as well as the public interest in the dispute, <br />separate from concentrating upon the legal issues. Through mediation, <br />solutions to disputes can oftentimes be achieved at considerably less than <br />the cost to litigate. <br />Please review the attached proposed Informal Interjurisdictional Mediation <br />Process and provide any comments you may have to Council by December 28, <br />1985. If you have any questions, please do not hesitate to call. <br />Chairman Lyons noted that no action was needed by the Board <br />on this matter; he just wanted to bring it to the Board's <br />attention. <br />PROGRESS REPORT ON MINIMUM -SECURITY JAIL FACILITY <br />Chairman Lyons reported that the plans for a minimum <br />security facility are being work on very actively and it looks as <br />if they will be completed very shortly. <br />Commissioner Scurlock asked if we had to go to competitive <br />bidding for construction again, and Chairman Lyons hoped to <br />negotiate a competitive and reasonable price from the present <br />contractor but only after the architect determines what the cost <br />per square foot should run. <br />Attorney Vitunac confirmed that we do have the ability to <br />negotiate with the present contractor and not go to competitive <br />bidding. <br />Administrator Wright explained that the architect will check <br />against other comparable jobs to see if we have received a <br />competitive price. <br />Commissioner Scurlock believed this was an opportune time to <br />get good, competitive construction prices. <br />Administrator Wright recommended that the Board authorize a <br />negotiating team of one Commissioner, staff, and the architect, <br />to talk with RS&H and come back to the Board with a price. <br />The Commissioners indicated they would do that after they <br />saw the plans. <br />79 <br />��oK 62 PA.401 <br />
