FOURTH AMENDMENT TO <br /> a OPTION AGREEMENT <br /> FOR SALE AND PURCHASE <br /> This Amendment, made this s N day of , 1998 between <br /> INDIAN RIVER COUNTY(Purchaser)And the IRWIN (Seller); <br /> WITNESSETH: <br /> WHEREAS, on July 2, 1997 an Option Agreement for Sale and Purchase was <br /> entered into between Purchaser and Seller;and <br /> WHEREAS, Purchaser is entering into a cost share purchase with the Board of <br /> Trustees of the Internal Improvement Trust Fund of the State of Florida;and <br /> WHEREAS, the Option Agreement contains an incorrect legal description of <br /> the Property;and <br /> WHEREAS, all parties are hereto wish to amend the Option Agreement to <br /> correct the legal description of the Property. <br /> NOW, THEREFORE, in consideration of the mutual terms, conditions, <br /> promises,covenants and other consideration which is hereby acknowledged,Purchaser <br /> and Seller agree as follows: <br /> 1. The Option Agreement is amended to substitute the legal description of the <br /> Property which is attached hereto as Exhibit A and made a part hereof for the legal <br /> description of the Property attached as Exhibit A to the Option Agreement. <br /> 2. The terms of this Amendment shall be binding upon and inure to the benefit <br /> of the parties hereto and their respective heirs,personal representatives,successors and <br /> assigns. <br /> 3. Except as expressly set forth herein, the Option Agreement shall remain in <br /> full force and effect and is hereby ratified and confirmed as of the Amendment date. <br />
