Environment <br />The subject property is not designated as environmentally sensi- <br />tive nor is it in a flood -prone area. <br />Utilities <br />The subject property will be served by City water, however, <br />wastewater facilities are not available at the present time. <br />RECOMMENDATION <br />Based on the the above analysis, including the Planning and <br />Zoning Commission's recommendation, staff recommends approval. <br />Commissioner Bowman noticed that 6th Avenue is already at D <br />level of transportation service and asked how close it is to <br />becoming Level E. She also asked if staff has considered what <br />the level of service will be when the area is built out. <br />Planning & Development Director Robert Keating advised that <br />a similar matter is going to be discussed tomorrow night at the <br />Planning & Zoning meeting, and staff is recommending that <br />particular site plan be approved and building commenced, with the <br />Certificate of Occupancy contingent on 60 Avenue being widened <br />to three lanes from 12th Street to 17th Street, or Indian River <br />Boulevard being put in place. It is the opinion of the Public <br />Works Department that those two alternatives would improve the <br />level of service on 6th Avenue in that area. <br />Chairman Scurlock asked why staff would allow construction <br />to begin before permanent plans were in place to actually <br />construct those improvements. <br />Administrator Wright believed we could do that, but pointed <br />out that in the Wal-Mart case, the County allowed construction <br />without allowing occupancy until the Boulevard is built. The <br />County did that feeling relatively sure that the Boulevard would <br />be constructed; however, if the Boulevard is not built, the <br />developer is responsible for doing something else to lessen the <br />impact caused by his property. <br />Chairman Scurlock did not want the County to have to <br />litigate that matter, but Attorney Vitunac explained that the <br />developer has the choice of being denied on the spot or taking <br />JAN 8 196 <br />27 <br />9001E PAGE ID® <br />
