D'. Committed tower utilization space, including <br />protective clearance above and below the antenna(s), not'to exceed <br />20 feet. <br />2. The term of the lease and the Lessee's obligation to pay <br />rent shall commence on the 27th day of January, 1986. The term of <br />this lease shall be 4 years following the commencement of the term <br />provided herein and may be renewed annually thereafter unless <br />within thirty days prior to the expiration of the term thereof, or <br />any_renewal under this provision, either the Lessor or the Lessees <br />shall notify, in writing the other party to this lease that it <br />does not desire to have the lease renewed. The Lessor reserves <br />the right to terminate this agreement upon sixty days prior <br />written notice by Lessor to Lessee that the property is needed for <br />an overriding public purpose. <br />The rent for each succeeding year may be subject to review <br />and renegotiation yearly no less than sixty days prior to the <br />renewal date contained herein. In the event the parties hereto <br />fail to agree upon a reasonable rental fee for the following year, <br />this agreement shall terminate automatically pursuant to the terms <br />stated herein. <br />The Lessor shall have the right to terminate this lease at <br />any time if <br />A. Lessee's operations at any time or in any way <br />interfere with those of the Lessor and cannot be fixed within a <br />reasonable time. . <br />B. Lessor decides to abandon the facility leased, or <br />remove the same from its present location.to a new location. <br />C. the facility leased to wholly or partially destroyed <br />from any cause, or condemned for public purpose. <br />3. Lessee shall pay Lessor at 1840 25th Street, Vero Beach, <br />Florida, 32960 an annual rental of $2,160.00 payable at a monthly <br />rate of $180.00 per month and due on the first day of each and <br />every month during the term of this lease. <br />4. Lessee shall have the right to use the utility electrical <br />service of the Lessor located at the tower site in order to <br />operate and/or repair Lessee's radio units. <br />5. During the term of this lease, Lessor agrees that Lessee <br />shall have free access to the tower and the premises on which the <br />tower is located 24 hours per day, for the purpose of installing, <br />maintaining and repairing, and removing its equipment. <br />6. Lessee's equipment, its installation, maintenance, <br />repair, and removal will: <br />A. in no way damage the premises or tower structure; <br />B. in no way interfere with the maintenance of the <br />Lessor's property; <br />C. in no way interfere with the operations of Lessor's <br />radio or frequency modulation transmitting systems now installed <br />on the property and premises of lessor. If there is any <br />interference, lessee will take immediately, all steps necessary to <br />remove said interference, the Lessor is authorized to take steps <br />necessary at once and the Lessee shall be responsible for the cost <br />or - .the, steps so taken. <br />D. comply with all applicable rules and regulations of <br />the Federal Communications Commission, Civil Aeronautics <br />Administration, and electrical codes of the city, county or state <br />concerned, and all other laws and regulations. <br />13 <br />L- JAN 1 5 1986 BOCK 63 pn,J� 254 <br />
