Lessor reserves the right to grant radio antenna leases <br />o other parties -on any frequency and shall be under no <br />.X esponsibility to Lessee for doing so. If Lessee should claim <br />hat the operation of such other parties involved interfere with <br />INITIA'. PEPE is operation, it shall be the Lessee's obligation to work out the <br />atter with such other parties.and Lessor shall not be involved in <br />nv +»t-Prferonc" o operatt na D ob ms_ If Lessee is un b' <br />- -to work out" the mater with sucrh 0 er parties, Lessee slael be <br />entit� ed to terminate this leasee <br />Lessor agrees: <br />A. to maintain the radio tower in good` working <br />condition at all times in order that the Lessee may have the use <br />of said tower as contemplated herein. <br />B. to maintain at all times the painting on the radio <br />tower,- and lights thereon, strictly in accordance with the <br />requirements of the Federal Communications Commission. <br />9. The Lessee does hereby .agree to indemnify and save the <br />County harmless. from any and all cl4tims, liability, losses and <br />?;..IIT :; �,g�c causes of action which may arise out of* this lease agreement or <br />"_-the lessee'.s activity on the demised premises. The Lessee shall <br />pay all claims and losses of any nature whatsoever in connection <br />a - therewith, and shall defend all suits, at the County's request, in <br />the name of the County when applicable, and pay all costs and <br />judgments which issue therefrom. <br />"- 10. Lessee shall obtain and keep in force during the term of <br />i this lease, 'insurance with a company or- companies approved by <br />`Lessor containing public- liability and property coverage <br />*Lessee's interest in the leased premises under <br />acceptable to Lessor, which latter coverage shall include the <br />property of Lessor. Such insurance which shall name Lessor as an <br />insured as well as Lessee, shall be in the amount not less than <br />$100,000.00 for personal injuries to any one person in any one <br />accident, and $300.0000.00 to a number of persons for personal <br />injuries in any one accident, and property damage in an amount not <br />less than $100,000.00 resulting from one or more accidents, or a <br />combination of one or more accidents; <br />11. This lease shall not be assigned without Lessor's <br />written consent. <br />12. At the termination of this lease, Lessee shall promptly <br />remove all its equipment, construction, and installations, and <br />upon removal shall at its expense restore Lessor's properties to <br />1NATIA.K;RE the same good order and condition as they were immediatelv <br />previous to the beginning of this leaset fair wear and tear excepted. <br />l� Any written notice, demand, or citation under this lease may <br />be served on Lessor at 1840 25th Street, Vero Beach, Florida, <br />32960, and on Lessee at 1000 36th Street, Vero Beach, Florida, <br />32960. <br />14 <br />- M M <br />
