Commissioner Wodtke inquired if this was site planned as an <br />individual owner and now will change so it will be s.old,separ- <br />ately, and Planning Director Keating confirmed that this is <br />comparable to a situation at Waverly Place where the site plan <br />came in and then they decided to go to land condominiums. <br />Commissioner Wodtke wished to know if this had been platted <br />originally as a land condominium whether the construction re- <br />quirements and those for water and sewer would have been <br />different, and Planner Boling stated they would not; it would <br />have been approved as submitted originally. <br />ON MOTION by Commissioner Scurlock, SECONDED by <br />Commissioner Bowman, the Board unanimously granted <br />Final Plat Approval to Old Dixie Plaza Subdivision. <br />MAY 15 1985 <br />Mr. Berlin felt there is no doubt the county accepted this <br />as being a land condo, and there can be criminal charges brought <br />if someone sells property as condominium without the proper papers <br />being filed in Tallahassee. No papers have ever been filed for <br />condo sale on this property, but property has been sold; he <br />bought two lots himself. <br />Mr. Berlin then went on to inform the Board that Attorney <br />George Glenn prepared the papers for the sale as directed by the <br />then County Attorneys, and those papers were prepared for the <br />lots to be sold as party wall lots. Why, therefore, was this <br />brought before the Commission and misrepresented as bei.ng a condo <br />sale? He felt the reason is that somebody anticipated Mr. <br />Wodtke's question as to whether the way this had been planned <br />originally, would it have been approved for a condominium lot <br />subdivision, and the answer was yes. If they had come in <br />and asked for a subdivision the way it was actually sold as a <br />party wall subdivision, and the question had been asked if it <br />would comply with party wall regulations, they would have had to <br />say no and the Board would have turned it down.
