JAN 15 1996 Boas 63 rnur- 295 <br />explained that every store would had to have had a fire wall to <br />be sold as a party wall condo, and Fire Code states that it must <br />be a 3 hour fire wall, which is an 8" block wall filled with <br />concrete with reinforcing roads attached to footings underneath <br />and also extending 3' above the roof. He bought his two stores <br />as party wall condos; so, he has an illegal purchase; his deed is <br />no good; and he can't resell it. It was sold to him as one <br />thing, the Board approved it as something else. and that is why <br />he is here. <br />Mr. Berlin then stated that regarding the actual construc- <br />tion of the building, the engineer never provided for any <br />drainage. The engineer said he assumed there was a ditch running <br />along the railroad tracks these retention areas would drain into, <br />but a letter from staff indicates that the railroad does not <br />permit private people to drain on their property and advised that <br />they should pay attention to this on their application. No <br />application was ever made by the engineer for these two sites. <br />There should have been two applications; there are two owners. <br />There should have been two sets of plans, and there wasn't even <br />one. It was assumed that they took over his wife's papers issued <br />to her some months before, but nobody ever got authorization to <br />use those. Mr. Berlin noted that the contractor of record is <br />present and will present testimony. <br />David Autry came before the Board and was sworn in by <br />Attorney Vitunac. <br />Mr. Autry confirmed that he is the contractor of record. He <br />emphasized that he is not an engineer or an architect; he builds <br />buildings on site to specifications, and he did not wish to <br />discuss other situations of the property, the water table, the <br />legalities, etc., which he had nothing to do with. <br />Attorney Vitunac asked if the Building Department had any <br />questions for Mr. Autry. <br />Building Director Ester Rymer asked Mr. Autry if he applied <br />for one building permit for two buildings and in whose name. <br />54 <br />� o r <br />
