Dr. Springer feels that <br />the building is safe and that there is no problem with it. Mr. <br />Nelson advised that they received a change of use for this from <br />the Technical Review Committee yesterday, depending on the <br />Commission's decision today. Mr. Nelson urged that the Board not <br />deny Dr. Springer the opportunity to rent to the church and <br />emphasized that Dr. Springer is covered with insurance which has <br />not been canceled. <br />Mr. Berlin interjected that he did not say the insurance had <br />been canceled, but just asked that he receive some protection <br />from the county in the event it became canceled because he did <br />feel the county committed quite a few errors both during and <br />prior to construction of this project. He believed the engineer <br />was at fault, but the error should have been caught. He further <br />pointed out that Harlan Peterson, the engineer who gave the <br />expert advice to Mr. Nelson re the building, is the same man who <br />drew the plans; an independent engineering firm was not called <br />in. Mr. Berlin felt the Commissioners should personally view the <br />problems before they make any decision. <br />Commissioner Lyons asked if Mr. Berlin is saying that he <br />considers the building unsafe far occupancy. <br />Mr. Berlin advised that the one building has heavy settling <br />cracks. He has not been in the other building except for the one <br />store he owns, and the floor is covered with vinyl tile so he <br />can't see what is going on. However, -seeing the condition of the <br />parking lot and looking into the roll-over grills and seeing <br />water 7-8" below the surface and knowing it is also underneath <br />those building, seeing settlement cracks in the other building, <br />and the floor having dropped 12" already would make him nervous. <br />Mr. Berlin stated that he will not rent his building and put a <br />tenant in it as he believes it is a dangerous situation.
