� s � <br />involved in the whole transaction, which he felt were reason <br />enough to stop the use of the shopping center until this is all <br />straightened out. _ <br />Chairman Scurlock asked if Mr. Berlin was suggesting the <br />applications for these permits were made with the intention to <br />defraud the county. <br />Mr. Berlin stated that he was not; he was just saying the <br />engineering was done poorly and as a result the whole building is <br />jeopardized. <br />Commissioner Lyons felt the only person who could testify <br />whether the building actually is unsafe for the public to occupy <br />would be a qualified engineer, and he asked if Mr. Berlin was <br />willing to get an engineering opinion to that effect. He felt if <br />this were done, the county would be forced to take the position <br />the building should be closed. <br />Mr. Berlin advised that his stand is that he came here to <br />speak and put the Board on notice of these things, and if the <br />Board wants to let the building be occupied, it is at their risk. <br />He did not feel he has to prove anything. <br />Chairman Scurlock determined there was no further input. He <br />thereupon directed Planning Director Keating to put in writing <br />the answers to the questions raised by Mr. Berlin. <br />Director Keating confirmed that he will do so, but felt Mr. <br />Berlin wants a decision today about the CO's. <br />Chairman Scurlock felt they already have been issued. <br />Director Keating noted that a change of use, of which Mr. <br />Nelson spoke, was given by the TPC yesterday based on the <br />condition that no adverse action was taken by the Board today. <br />Chairman Scurlock did not see how the Board can take action <br />without seeing the staff's response to Mr. Berlin's questions. <br />Administrator Wright stated that in the absence of action, <br />staff would recommend the CO be allowed. <br />Commissioner Wodtke asked if we have the ability to do an <br />inspection of the building they want to occupy.
