Attorney Barkett felt that the proposed ordinance as <br />presented satisfies the requirements of the recent Supreme Court <br />ruling. <br />Chairman Scurlock asked how this would affect a married <br />couple who take in 4-5 foster children at a time on a temporary <br />basis, and Mr. Shearer advised that foster homes are defined <br />specifically in the ordinance and are listed as a permitted use <br />in single-family zoning districts. However, the ordinance does <br />not stipulate how many foster children are allowed at one time. <br />Attorney Barkett explained that foster homes are regulated <br />by the State and need a HRS permit, which would limit the number <br />of children in a particular home. <br />Commissioner Lyons believed the proposed ordinance needed <br />more preparation because under it 14 people could live in a <br />single-family home with only 1500 square feet. The minimum <br />dwelling space requirements are only 100 square feet per person. <br />Director Keating explained that there are situations where 5 <br />or 8 unrelated persons could five together as a single house- <br />keeping unit in a single-family zoning district; however, these <br />situations would need to obtain an administrative permitted use, <br />which is one step below the special exception use where they have <br />to get permission from the P&Z Commission. What staff is recom- <br />mending is that we add wording and make a few minor changes which <br />would require public notices and notification to adjacent <br />residents so that they would be aware of the proposed use. <br />Attorney Barkett advised that the administrative permits <br />allow consideration of the specific use and whether it is going <br />to be compatible with the neighborhood or cause a known, definite <br />danger. <br />Director Keating stated that there is specific criteria in <br />the ordinance to try to preserve the character of the residential <br />neighborhood.
