JAR a 2 1986 BOOK 63 PIA, GE 405 <br />Under discussion, Don Finney, County Right -of -Way <br />Acquisition Agent, noted that during negotiations the property <br />owners would not budge one dollar from their asking price of <br />$5,000. He felt that the staff appraisal was rather conservative' - <br />and that it was possible that the value has increased during the <br />last six months. <br />Commissioner Bird felt inclined to go with the Motion except <br />for the stipulation that if the $3,500 is not accepted, it goes <br />to condemnation. He was concerned about the gamble we would be <br />taking because he believed the appraisal would be higher than <br />$2500. <br />Chairman Scurlock agreed that the appraisal would come in <br />higher. In addition, he believed the attorney fees would be more <br />than $1500, which doesn't include our County Attorney's time. <br />Director Davis pointed out that staff's appraisal was based <br />on comparable sales, and for another appraiser to justify a <br />higher appraisal, he would have to show comparable sales in that <br />area. He didn't know where they could find those unless something <br />significant has happened in that area in the last six months. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />failed by a 2-2 vote, Commissioners Scurlock and <br />Bird dissenting. <br />A MOTION MADE by Commissioner Bird, SECONDED by <br />Commissioner Bowman, that the Board approve staff <br />recommendation of alternate #3 as set out in the above <br />memo, failed by a vote of 2-2, Commissioners Wodtke <br />and Bowman dissenting. <br />Administrator Wright advised that the matter would be <br />brought back to the Board at the February 5th meeting. <br />77 <br />r <br />
