JAN 2 2.1966 �ooK 63 43? <br />NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />SECTION I. <br />Short Title, Authority and Applicability <br />A. This ordinance shall be known and may be cited as <br />the "Indian River County Fair Share Roadway Improvements <br />Ordinance". <br />B. The County Commission has authority to adopt this <br />ordinance through its general non -charter home rule powers <br />pursuant to Article VIII 'of the 1968 Florida Constitution, and <br />Sections 125 and 163, Florida Statutes. <br />C. This ordinance shall apply to the unincorporated <br />area of Indian River County, and to the incorporated areas of <br />Indian River County to the extent permitted by Article VIII, <br />Section 1(f) of the 1968 Constitution. <br />SECTION II. <br />Intent and Purpose <br />A. Planning for the necessary capacity expansion of <br />Indian River County's major road network system to insure the <br />safety and efficiency of the County's roads and to provide for <br />the health, safety, welfare and economic well being of the <br />citizens of Indian River County is the mandated responsibility of <br />the County pursuant to Section 163.3161 et. seq. Florida <br />Statutes, the Florida Local Government Comprehensive Planning and <br />Land Development Regulation Act, and Section 125.01, Florida <br />Statutes. <br />B. This ordinance is intended to implement and be <br />consistent with the Indian River County Comprehensive Plan and <br />the Florida Local Government Comprehensive Planning and Land <br />Development Regulation Act, Section 163.3161 et. seq., Florida <br />Statutes. <br />C. This objective is accomplished by requiring all new <br />land development activity that places additional demand on the <br />County's major- road network system to contribute its <br />proportionate share of the funds, land, or public facilities to <br />- 3 - <br />
