accomodate any transportation impacts having a rational nexus to the proposed development and for which the need is reasonably attributable to the proposed development. D. It is not the purpose of this ordinance to collect any funds, land or public facilities from new land development activity in excess of the actual amount necessary to offset the _ demand'bn the County's major road network system generated by the new land development activity. This ordinance is intended to be consistent with the principles for allocating a fair share of the cost of new public facilities to new users as established in Contractors and Builders Association of Pinellas County v. City of Dunedin, 329'So.2d 314 (Fla. 1976), and Homebuilders and Contractors Association of Palm Beach County v. Palm Beach County, 446 So.2d 140 (Fla. 4th DCA 1983). SECTION III. Rules of Construction In the construction of this ordinance, the rules set out in this section shall be observed unless such construction is inconsistent with the manifest intent of the Indian River County Board of County Commissioners. The rules of construction and definitions set out here shall not be applied to any section of this ordinance which contains any express provisions excluding such construction, or where the subject matter or content of such section would be inconsistent with this section. A. Generally. All provisions, terms, phrases and expressions contained in this ordinance shall be liberally construed in order that the true intent and meaning of the Indian River County Board of County Commissioners may be fully carried out. Terms used in this ordinance, unless otherwise specifically provided, shall have the meanings prescribed by the statutes of this state for the same terms. B. Text.
