No credit shall be granted for <br />any contribution, payment, construction, or land received by <br />Indian River County where a building permit has been issued prior <br />to the effective date of this ordinance for a portion of a <br />proposed development, to the extent said contribution, payment, <br />construction or land is to provide capacity expansion to the <br />County's major road network required by the portion of the <br />development for which the building permit has been issued. <br />B. The credit shall be in an amount equal to the <br />market value of the contribution, payment, construction, or land <br />at the time of the contribution, payment, construction, or land <br />dedication. No credit shall exceed the fee for the proposed <br />impact generating activity imposed by this ordinance. <br />C. The determination of any credit shall be undertaken <br />through the submission of a proposed Credit Agreement to the <br />County Administrator or his designee. The proposed Credit <br />Agreement shall include the following information: <br />(1) If the proposed Credit Agreement involves <br />credit for the dedication of land: <br />a. A drawing and legal description of <br />the land; <br />b. The appraised fair market value of <br />the land at the date of its dedication, <br />prepared by a certified Florida Real Property <br />Appraiser approved by the County Administrator <br />or his designee, and if applicable; <br />C. A certified copy of the development <br />order in which the land was agreed to be <br />dedicated. <br />_ (2) If the proposed Credit Agreement involves <br />_ construction: <br />a•_ The proposed plan of the specific <br />construction prepared and certified by a duly <br />- 19 - <br />® M r <br />
