complete, he shall send a written. statement specifying the <br />deficiencies by mail to the person submitting the --Traffic <br />Impact Analysis. Unless the deficiencies are corrected, the <br />County Administrator shall take no further action on the Traffic <br />Impact Analysis. <br />(6) When the County Administrator determines the <br />Traffic Impact Analysis contesting the Fair Share Fee <br />Determination is complete, he shall review it within twenty (20) <br />days. The Fair Share Fee Determination shall be modified if on <br />the basis of generally recognized principles of traffic <br />engineering it is determined in the Traffic Impact Analysis that <br />the County's cost to accomodate the proposed land development <br />activity is substantially different from the Fair Share Fee <br />Determination. The modification shall be consistent with the <br />information and analysis in the Traffic Impact Analysis. <br />(7) Any person may appeal the County <br />Administrator's determination of a Traffic Impact Analysis they <br />submit contesting a Fair Share Fee Determination by filing a <br />petition with the Board of County Commissioners within thirty <br />(30) days of a decision of the County Administrator. In <br />reviewing the County Administrator's decision, the Board of <br />County Commissioners shall use the standards established in <br />Section VII.B.(6). <br />SECTION VIII: <br />Credits to the Fair Share Roadway Improvements Fee <br />A. Any person who shall commence any land development <br />activity generating traffic may apply for a credit against any <br />fee paid pursuant to the provisions of this ordinance for any <br />contribution, payment, construction, or land accepted and <br />received by Indian River County or any municipality participating <br />in this ordinance, including any contribution, payment or <br />construction made pursuant to a development order issued by <br />Indian River County or any participating municipality pursuant to <br />its local development regulations or Section 380.06, Florida <br />Statutes, or any additional development requirement imposed by <br />- 18 - <br />JAN 2 2 1986 Boor 63 P,� 44 7 <br />
