We have followed the law and published all <br />required notices in the local newspapers. <br />Administrator Wright pointed out that in order for Mr. <br />Pozniac to put a salvage yard in there, the Board would have to <br />change the 500 ft. restriction and that would require adopting <br />another ordinance. That cannot be done at tonight's public <br />hearing because it hasn't been advertised for that purpose. <br />Commissioner Lyons felt that if the present ordinances say <br />that the property cannot be used for a salvage yard, then it <br />should be rezoned consistent with the ordinances. If we change <br />the ordinances, then there is the opportunity to go back and <br />revisit the matter. - <br />Commissioner Wodtke preferred to have all the junk yards in <br />one area, but he did not know how we could control that. <br />Mr. Pozniac noted that there are other salvage yards around <br />there and did not understand why he was being singled out. <br />Commissioner Bird pointed out that if Mr. Pozniac had <br />activated his site plan that was approved in 1983, he would be <br />grandfathered in like the other salvage yards in that area, and <br />would not even be here tonight. He further noted that Mr. <br />Pozniac has many options open to him with the CL zoning. <br />Chairman Scurlock stressed that Mr. Pozniac always has the <br />ability to come back and request a rezoning or a Comp Plan <br />amendment. <br />William Collins, Attorney representing J. B. Malone, owner <br />of property along the east side of U.S. #1 and the north side of <br />37th Street, the entrance to the hospital node, objected to the <br />proposed change in zoning from C-1 to RM -8. He circulated a <br />survey of the triangular piece in question and wanted the -Board <br />to be aware that this is not a deep piece of property even though <br />it has 217 feet of frontage. The problem is that the proposed <br />RM -8 zoning requires a 20 -ft, front setback and a 25 -ft. rear <br />setback, but the property is only 25 ft. deep at the widest point <br />and contains less than 6000 square feet.
