COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, Herein referred to <br />as the "County"; <br />W I T N E S S E T ii : <br />WHEREAS, the parties to this Stipulation are currently <br />involved in litigation in the above -styled cause; and <br />WHEREAS, this action was instituted by the Department <br />to seek compliance with the rules and regulations contained in <br />Chapter 33-8, F.A.C., as they relate to the conditions at the <br />Indian River County Detention Facility; and <br />WHEREAS, certain issues raised in the above-described <br />action will be resolved by*the actions of the parties pursuant to <br />this stipulation; and <br />WHEREAS, the County is in the process of constructing <br />new County Detention Facilities; and <br />WHEREAS, it is in the best interest of justice to <br />resolve the issues in this action and that the resolution of the <br />issues, as to the conditions at the Indian River County Detention <br />Facility, will resolve all remaining matters in this action; <br />NOW, THEREFORE, in consideration of the actions to be <br />taken and of the further covenants contained herein, the parties <br />agree, covenant and stipulate to the following: <br />1. That on or before February 10, 1986, the County <br />shall reduce the population of the Indian River County Detention <br />Facility to its state authorizePcapacity of seventy-three (73) <br />and shall be in full compliance with the rules and regulations of <br />including the exercise requirements _. <br />Chapter 33-8, F.A.C./ with regard to the population -capacity of <br />the County Detention Facility. Defendant may, during the interim <br />period from the signing of this agreement until November 1, 1986, <br />as circumstances warrant, exceed the authorized capacity of the <br />County Detention Facility for no more than forty-eight (48) <br />consecutive hours. Defendant agrees to provide Plaintiff monthly <br />inmate population counts during the interim period. <br />2. That in order to reduce the population of the <br />Indian River County Detention Facility and achieve and maintain <br />the authorized population Level, Defendant shall implement a <br />"Fast -Track Committee".
