BOOK �� a� FA G E �JL11 -, <br />� <br />Chief Judge of the Nineteenth Judicial Circuit, or his designee; <br />a representative of the Indian River County State's Attorney <br />office; a representative of the Indian River County Public <br />Defender's office; the Indian River County Jail Administrator, or <br />his designee; and, two (2) private citizens appointed at -large by <br />the Board of County Commissioners of Indian River County. The <br />"Fast -Track Committee" shall meet on an as needed basis, during <br />the interim period and until the new Indian River County <br />Detention Facility is fully operational, to determine and <br />recommend which inmates, if any, must be released or transferred <br />to another program under the terms of this agreement, in order to <br />maintain the population of the Indian River County Detention <br />Facility within the authorized state capacity of seventy-three <br />(73) . <br />3. That the Defendant agrees that the present level of <br />compliance with Chapter 33-8, F.A.C., particularly with respect <br />inspection report dated April 3, 1985, shall be maintained at its <br />current level or improved during the interim period from the <br />signing of this Stipulation until November 1, 1986, at which time <br />Defendant shall begin operation of the new County Detention <br />Facility and shall cease utilizing the existing County Detention <br />Facility for the incarceration o? pre-trial detainees and <br />sentenced prisoners, until such time as the existing facility is <br />in full compliance with the requirements of Chapter 33-8, F.A.C. <br />Under no circumstances shall the Defendants allow the Indian <br />River County Detention Facility to deteriorate from the current <br />level of compliance with applicable regulations. The time period <br />commitment in this paragraph is without prejudice to Defendant to <br />move for an extension of time for good cause shown. <br />4. That as long as Defendant maintain the present <br />level of compliance with Chapter 33-8, F.A.C., or improve that <br />compliance, that the Department shall hold all further action in <br />connection with this case in abeyance, until November 1, 1986. <br />This cause shall not be subject to dismissal for failure to <br />prosecute during this interim period. <br />22 <br />
