F E B 5 196 <br />aaolc 63 F,�cE 531 <br />Motion was made by Commissioner Lyons to accept staff's <br />recommendation of alternative 3. <br />Commissioner Bird advised that he had talked to Mr. Carter <br />and urged him to accept the County's appraisal, and he wished to <br />know if staff had heard anything more from Mr. Carter since then. <br />Public Works Director Davis reported that nothing further <br />has been heard, and Administrator Wright pointed out that the <br />staff recommendation has changed since the last meeting. He <br />believed we said we would offer $3,500 before as we did not want <br />to get into the situation of paying full value for land, plus all <br />attorney's fees, etc., even though taking this to condemnation <br />probably would cost more. <br />Commissioner Wodtke stated that while he understands the <br />economics of the situation,- his real concern is that we would be <br />telling other people we need to get R/W from that they can hold <br />out and determine what court costs and attorney's fees might be, <br />etc., and he did not feel this is a good signal to send out. <br />However, he realized if we go with an order of condemnation, it <br />could not only cause considerable delay but could end up costing <br />more; so, his suggestion was to offer them $3,500 and if they <br />don't take that, then go to condemnation. <br />Commissioner Lyons withdrew his Motion. <br />Commissioner Bowman asked if $3,500 was offered, and <br />Director Davis informed the Board that in negotiations we tried <br />to leave all avenues open, and we were told flat out that they <br />would not accept a nickel less than $5,000. <br />Discussion continued re condemnation, and Attorney Vitunac <br />explained the "quick taking" condemnation process. <br />The Chairman asked the County Attorney's opinion of a more <br />realistic figure of attorney's fees for both in-house and outside <br />legal counsel as he felt $1,500 was a low figure. <br />Attorney Vitunac noted that the attorney we are paying now <br />to condemn the R/W for the electrical line on North Gifford Road <br />is charging $200 an hour.
