FEB 5 19969ooi< C� 3s,y551 <br />r",1n <br />STAFF RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners con- <br />sider obtaining a voluntary payment of up to $3,000 dollars and <br />appropriate restoration of the area from the property <br />owner. In the event that any such agreement is not forth- <br />coming, staff recommends that the Board of County <br />Commissioners grant staff the authorization to pursue available <br />remedies in County court. <br />Commissioner Wodtke had a question re the traffic on Quay <br />Dock Road as he noted that was Mrs. Halpin's reason for trimming <br />the mangroves. <br />Planner Challacombe explained that there are two houses on <br />the river there which share a common drive, and there is a <br />hairpin turn. <br />Mrs. Halpin informed the Board that they have almost had two <br />head—on collisions; where the cars come in, there is a turn, and <br />the branches came out over the driveway. Mrs. Halpin stated that <br />she trimmed the trees leaving a root system, and actually did not <br />even realize they were mangroves. <br />would be willing to replant. <br />She did this in ignorance and <br />Commissioner Wodtke asked if Mrs. Halpin trimmed the man- <br />groves herself, and she confirmed that she did. <br />Commissioner Bird inquired if the trimming killed the trees, <br />and Planner Challacombe was not positive, but noted they are in <br />such a state that it will take years for them to come back. <br />Commissioner Bird felt if Mrs. Halpin had applied for a <br />permit she probably would have been allowed to trim, but not to <br />that extent or in that time period. <br />Planner Challacombe agreed, and pointed out that staff would <br />like the applicant to contact them first so they can look at the <br />situation and offer recommendations for pruning and trimming. <br />Commissioner Lyons realized this probably was done in <br />innocence, but he did feel there should be some fine. He <br />recommended $100 a tree, or possibly a total of $300.00. <br />Chairman Scurlock agreed there should be some mitigation due <br />to the problem with the traffic situation. <br />62 <br />-7 <br />
