RECOMMENDATION <br />Authorize staff to solicit emergency bids for immediate replace- <br />ment of the courthouse roof with payment to come from the Board <br />of County Commission Contingency Fund and instruct County Attor- <br />ney's staff to begin litigation. <br />Replacement will take between three to four weeks depending <br />upon weather and court schedules. Replacement during the summer <br />months would be extremely difficult, if not impossible. <br />General Services Director Sonny Dean advised of the <br />substantial damage to the Courthouse because of the leaking roof. <br />Assistant County Attorney James Wilson reported that he has <br />been in contact with the insurance company, who have informed us <br />that they intend to pay only $15,000. They also intend to <br />pro -rate the warranty because the roof has been installed for 5 <br />years with no problems, according to them. The warranty <br />specifically states that if there are any leaks or problems with <br />the roof, the company will repair/replace the roof at their cost. <br />Furthermore, they have not indicated that our estimate is not <br />reasonable. Attorney Wilson felt that $33,000 is a reasonable <br />price and recommended that the Board authorize the Legal <br />Department to initiate a lawsuit against them in an attempt to <br />regain the full amount of the roof repairs and also authorize the <br />replacement of the roof as soon as possible. <br />Commissioner Lyons asked about the other damage, and <br />Administrator Wright explained that staff wants authorization to <br />repair everything and sue for everything. Funding will come from <br />the general contingencies which presently has a balance of <br />$194,538. <br />Lynn Williams, Superintendent of Buildings and Grounds, <br />reported that he had received another estimate from a roofer just <br />this morning, and he recommends replacing the entire roof all the <br />way downtothe deck at a price of $56,000.
