TO: Indian River County DATE: 'bruary 19, 1986 FILE: <br />Board of County Commissioners <br />4 <br />FEB 19986 UBJECT: APPOINTMENT AS A <br />tiSPECIAL ASSISTANT STATE <br />mcnVo cc, ATTORNEY <br />EOARO eOElM"I <br />r,oMmISSIOHERS <br />w <br />�'�"� REFERENCES: <br />FROM: P. <br />Wilson <br />County Attorney <br />Bruce Colton, State Attorney for the Nineteenth Judicial Circuit, <br />has appointed me as a Special Assistant State Attorney to <br />prosecute certain County ordinance violations. This appointment <br />does not extend to enforcement of County ordinance violations <br />such as animal control violations, which are currently handled by <br />the State Attorney's Office. Instead, this appointment will <br />allow the County staff to pursue an alternative me.ans to force <br />violators of the technical and zoning codes into compliance with <br />the Code. <br />As you know, the Indian River County Code Enforcement Board's <br />enforcement power is limited to placing a lien upon the real or <br />personal property of persons found in violation of the technical <br />County codes. In some instances, this power is insufficient to <br />ensure compliance with County ordinances. On the other hand, the <br />county court has the power to impose either a fine or a jail term <br />upon violators, and can force affirmative action to correct <br />violations through the court's contempt power. The court system <br />provides a much more direct and expedient means of forcing <br />compliance in extreme circumstances. <br />County staff is currently evaluating existing cases to determine <br />which forum should be used to obtain an appropriate response and <br />we anticipate filing actions in the County court in the near <br />future. <br />It is my opinion that we should express our gratitude to Bruce <br />Colton for his cooperation and assistance in this matter. <br />LEASE/PURCHASE IBM EQUIPMENT - COUNTY ATTORNEY <br />County Attorney Vitunac reviewed his request, as follows: <br />59 <br />FEB 2 6 1986 <br />BOOK 63 Fra:UC 7 72 <br />
