DESCRIPTION AND CONDITIONS <br />On February 13, 1986, the Planning and Zoning Commission <br />conditionally approved a minor site plan application submitted by <br />the Vero Beach Moose Lodge. Approval was granted to construct a <br />1,750 square foot addition to the club located on the east side of <br />43rd Avenue, south of 4th Street. Due to the fact that 43rd <br />Avenue is a primary collector and the subject property is within <br />the General Commercial zoning district, approval was conditioned <br />upon the applicant escrowing $3,471.00 for the construction of a 4 <br />foot wide concrete sidewalk, prior to the issuance of a certi- <br />ficate of occupancy. <br />The minor site plan, which would normally be approved at the <br />Technical Review Committee meeting, was presented to the Planning <br />and Zoning Commission on appeal of TRC's sidewalk requirement. It <br />is the Planning and Zoning Commission's decision to uphold the TRC <br />requirement that the Vero Beach Moose Lodge is appealing at this <br />time. <br />ANALYSIS <br />A. requirement of the Site Plan Ordinance, which was not depicted <br />on the site plan submitted for approval,. is the construction of <br />sidewalks along arterials and primary collectors; 43rd Avenue is a <br />primary collector. In addition, Section 20(A)L of the 'Zoning <br />Code, CG: General Commercial District, states that all site plans <br />within the CG zoning district shall provide sidewalks. No <br />differentiation is made between major and minor site plans with <br />regard to this requirement. The Technical Review Committee <br />informed the applicant that it would be sufficient to escrow the <br />cost of the sidewalk, rather than construct it -at this time; <br />however, the applicant chose to appeal the requirement to the <br />Planning and Zoning Commission. <br />In making their decision to grant conditional approval, the <br />Planning and Zoning Commission cited the fact that the require- <br />ments for sidewalks had been consistently upheld regardless of a <br />project's proximity to existing sidewalks. On November 11, 1985, <br />the Commission approved a minor site plan application submitted by <br />Don's Imports, located approximately J70 feet south of the Moose <br />Lodge. Approval was granted with the condition that funds be <br />escrowed for the construction of a sidewalk, and at that time a <br />sidewalk did not exist within a quarter mile north or south of the <br />auto repair facility. Since then, the Temple Beth Shalom, located <br />approximately 650 feet north of the Moose Lodge, has escrowed <br />funds for the construction of a sidewalk. In addition, Citrus <br />Elementary School is within a mile and one-quarter of the Moose <br />Lodge-. <br />RECOMMENDATION <br />Staff recommends that the appeal by the Vero Beach Moose Lodge be <br />denied, and the Planning and Zoning Commission's conditional <br />approval be upheld.. <br />Leo Franks, Governor of the Vero Beach Moose Lodge, believed <br />that if this was a new building, they would agree to paying for a <br />sidewalk, but pointed out that their building was built in 1979 <br />under the old ordinances.
