DEPARTMENT OF ENVIRONMENTAL REGULATION APPLICATION <br />NO. 31-117196-4 <br />APPLICANT: City of Vero Beach <br />P.O. Box 1389 <br />Vero Beach, FL 32961 <br />WATERWAY & LOCATION: <br />The project is located in the Atlantic Ocean adjacent to <br />Humiston Beach Park on Ocean Drive in Section 32, Township 32, <br />Range 40 East, Indian River County, Florida. <br />WORK & PURPOSE: The applicant, City of Vero Beach, proposes to <br />restore an existing stormwater outfall that was destroyed by <br />beach erosion; the outfall is to extend approximately 105 feet <br />waterward. No dredging or filling is to occur. <br />ALTERNATIVES & ANALYSIS: <br />The Planning and Development Division reviews and submits <br />comments on dredge and fill applications to the permitting <br />agencies based upon the following: <br />- The Conservation & Coastal Zoning Management Element of <br />the Indian River Comprehensive Plan <br />- Coastal Zone Management, Interim Goals, Objectives & <br />Policies for the Treasure Coast Region <br />- The Hutchinson Island Planning & Management Plan <br />- The Indian River County Code of Laws and Ordinances <br />The City of Vero Beach is proposing to restore an existing <br />stormwater outfall located within the City's jurisdiction. <br />Section 17-4.04(10)(j) of the Florida Administrative Code <br />indicates that the "repair or replacement of existing pipes to <br />original configurations for the purpose of discharge of storm - <br />water runoff" is exempted from D.E.R. permitting requirements. <br />In that any impacts associated with the project are site- <br />specific and not within the County's jurisdiction, restoration <br />of the stormwater outfall has no impact of County significance. <br />RECOMMENDATION: <br />It is recommended that the Board of County Commissioners <br />authorize staff to forward the following comment regarding this <br />project to the Florida Department of Environmental Regulation: <br />Indian River County has no objection to the project, in that <br />any associated impacts are within the City of Vero Beach and <br />not within County jurisdiction. <br />ON MOTION by Commissioner Wodtke, SECONDED by <br />Commissioner Bowman, the Board unanimously (3-0) <br />approved staff recommendation to forward a comment of <br />no objection to the proposed project. <br />13 <br />MARR 2 6 1986 BOOK. i.3 P,q 992 <br />
