MAR 2 6 1986 BOOK 63 F,tG ;10-25 <br />Mr. Schacht's attorney has prepared that resolution, which is <br />basically the same as the Tanen document. It is the same format <br />and involves the same conditions concerning the right-of-way with <br />the exception of the locations on the right-of-way. <br />MOTION WAS MADE by Commissioner Wodtke, SECONDED by <br />Commissioner Bowman, that the Board adopt Resolution <br />86-13, accepting under certain conditions the donation <br />of -right-of-way for the southerly extension of Indian <br />River Boulevard from R. A. Schacht and Peggy Schacht. <br />Commissioner Wodtke asked if there was anything in the <br />Resolution that requires the Schachts to apply for a rezoning <br />consistent with the Comprehensive Land Use Plan, and Chairman <br />Scurlock explained that the proposed Resolution states that Mr. <br />Schacht and his wife have indicated their intention to apply for <br />a zoning consistent with the Comp Plan. <br />Attorney Vitunac advised that they are not really required <br />to do that, but are merely putting the County on notice that they <br />are trying to get a higher density. We are merely acknowledging <br />their intention, and not promising anything. <br />THE CHAIRMAN CALLED FOR THE QUESTION. The Motion <br />was voted on and carried unanimously (3-0). <br />46 <br />
