DESCRIPTION & CONDITIONS <br />Last year, the Florida legislature enacted the -Local Government <br />Comprehensive Planning and Land Development Act. Among other <br />requirements, this act mandated local governments within the <br />state to develop comprehensive plans meeting certain minimum <br />criteria and to adopt these plans by specified dates. The act <br />also established a new procedure for adopting and amending <br />local plans. <br />Since adoption of the act, the state Department of Community <br />Affairs has drafted several rules implementing various aspects <br />of the act. On February 14, 1986, DCA adopted a rule estab- <br />lishing minimum criteria for local plans. Currently undergoing <br />public hearing is a rule to set time limits for adoption of <br />plans by local governments; Indian River County must submit its <br />completed plan to DCA by December 1, 1987. Most importantly, <br />DCA's rule 9J-10 has recently become effective. This rule <br />establishes procedures for allocating the $2,310,000 appro- <br />priated by the legislature to assist local governments---i-i <br />preparing their -required plans. <br />According. to DCA, Indian. -River- County is -eligible to receive <br />$31,703 in state funds in 1986 for use in complying with the <br />requirements of the LGCPLDA. No matching funds are required to <br />obtain the money, and there is a possibility that additional <br />funds will be available in 1986 and a probability that addi- <br />tional funds will be available for 1987. In order to receive <br />the funding, the County must submit to DCA prior to April 29, <br />1986 a scope of services identifying the activities to be <br />undertaken and work products to be prepared with the money. <br />After review by DCA, the scope of services will be incorporated <br />into a contract between the County and DCA. All work performed <br />pursuant to the contract must be completed prior to December 1, <br />1986. <br />Since establishment of the minimum criteria for local plans, <br />the Planning staff has developed a proposed work program to <br />prepare a plan meeting those requirements. Basically, this <br />work program involves an extensive update of the County's <br />current comprehensive plan, adding more data, addressing <br />additional issues, and preparing several new elements. Because <br />the staff has regularly reviewed the current comprehensive plan <br />in conjunction with plan amendment requests and because the <br />staff has been involved with other planning efforts including <br />the preparation of small area plans, coastal plans, transporta- <br />tion plans, and others, the task of preparing a plan meeting <br />the new state criteria should not be as extensive for Indian <br />River County as for some other local governments. However, <br />preparation of an acceptable plan will still require a substan- <br />tial commitment from the County in terms of staff time and <br />other related costs. <br />The staff has estimated that the cost of preparing a local <br />comprehensive plan meeting the requirements of the LGCPLDA will <br />be approximately $121,000. While most of the activities can be <br />done in-house using existing staff, there may be a need to <br />contract some work to consultants, increase staff, or use <br />part-time employees. <br />51 <br />APR 2 1986 Boa 64 r 14 51. <br />L <br />
