Since Sebastian Grove Estates is included in the Sebastian com- <br />mercial/industrial node and is zoned for heavy commercial uses, <br />the staff feels that some coordinated action should be taken in <br />this area to upgrade the roadways. It is the staff's position <br />that a forced paving assessment would accomplish that objective in <br />the most equitable manner. <br />RECOMMENDATION <br />The staff recommends that the Board direct the staff to implement <br />a forced paving petition throughout Sebastian Grove Estates that <br />will assess 100% of the cost of paving equitably among all the <br />benefiting property owners. <br />Planner Miller added that staff would like to modify their <br />recommendation concerning any reference to the 100% percent <br />contribution. <br />Chairman Scurlock wondered if there is enough potential <br />interest in the area to necessitate the Commission initiating <br />action for a forced petition, and he wished to know how this <br />differs from any other petition situation where we require our <br />indication of interest by 660. <br />Director Keating explained that since this property is in a <br />node area which the County has determined is appropriate for <br />non-residential development, staff feels the County probably <br />should assist the applicant in some regard and at least insure <br />the roads are up to standard. In addition, the paving require- <br />ment has discouraged several other applicants who were interested <br />in developing in this area. <br />Commissioner Bowman asked how many land owners are involved, <br />and Planner Miller advised there are five or six existing <br />businesses in the area; most of the 63 platted lots are undevel- <br />oped. <br />Cha"irman Scurlock believed it has been indicated those <br />owners have been contacted and are not interested in paving. His <br />main question was what responsibility we have because of accept - <br />Ing the original road for maintenance. <br />The Chairman asked if anyone present wished to speak, and <br />Randy Mosby of Mosby and Associates, Inc., came before the Board <br />representing the McClains. Mr. Mosby felt there is a question re <br />right-of-way on High Street - the plat shows a 30' R/W to the <br />39 <br />APR 16 1 BooK 6 P} ,r 175 <br />
