Heath R/E Pensch & Thigpen <br />FROM: Code Enforcement officer REFERENCES: DIS:REMS <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of April 16, 1986. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by Albert C. Pensch and Henry S. <br />Thigpen, owners of the subject property, for the release of the <br />easterly one (1) foot of the westerly twenty (20) foot utility <br />easement of Lot 1, Block A, Oakridge Subdivision, being the <br />easterly one foot of the twenty foot utility and drainage <br />easement of Lot 1, Block A, Section 25, Township 33 South, <br />Range 39, as recorded in Plat Book 11, Page 94, of the Public <br />Records of Indian River County, Florida. It is Mr. Pensch's <br />and Mr. Thigpen's intention to construct a single-family <br />residence on the site. <br />The current zoning classification is RS -3, Single -Family <br />Residential District. The land use designation is LD -1, Low <br />Density Residential, up to three (3) units per acre. <br />ALTERNATIVES AND ANALYSIS: <br />The request has been reviewed by Southern Bell, Florida Power <br />and Light, Florida Cablevision Corporation, and Indian River <br />County Utility and Right-of-way Departments. Based upon their <br />review, there were no objections to the release of the portion <br />of the twenty foot utility and drainage easement. The zoning <br />staff analysis, which included a site visit, showed that <br />drainage would be adequately handled on site. <br />RECOMMENDATION: <br />Staff recommends to the Board, through adoption of a <br />resolution, the release of the easterly one (1) foot of the <br />westerly twenty (20) foot utility and drainage easement of Lot <br />1, Block A, Oakridge Subdivision, as recorded in Plat Book 11, <br />Page 94, of the Public Records of Indian River County, Florida. <br />Commissioner Lyons wondered if it is better to cure this <br />problem by giving up part of the easement or by going to the <br />Board of Adjustment. <br />Director Keating advised that they had considered that <br />option but because it was necessary to survey all of the users of <br />5 <br />APR 16 1986 Bou 64 Pa, -)A41 <br />
