application as part of a request for special exception approval of <br />a noncommercial stable in the RS -6, Single Family Residential <br />District The subject property is located at the southeast corner <br />of 6th Street and 39th Avenue. <br />The proposed stable building will be approximately 1,200 square <br />feet in size and include space for 3 horses and space for storage <br />of a vehicle and yard tools. The building will be located over 80 <br />feet from the rear lot line and no less than 90 feet from side lot <br />lines. <br />Pursuant to Section 25.3 of the Zoning Code, Regulation of Special <br />Exception Uses, the Planning and Zoning Commission is to consider <br />the appropriateness of the- requested use based on the -submitted <br />site plan and the suitability of the site for that use. The <br />Commission then concurrently makes a recommendation to the Board <br />of County Commissioners regarding the special exception use and <br />acts on the submitted site plan. The County may attach any <br />conditions -and safeguards necessary to assure compatibility of the <br />use with the surrounding area. <br />At their meeting of May 8, 1986, the Planning and Zoning <br />Commission considered Lynn Poster's request. The Planning and <br />Zoning Commission voted to recommend to the Board of County <br />Commissioners that special exception approval of the noncommercial <br />stable be given, conditioned upon Board approval of the special <br />exception use. An analysis of the approved site plan is as <br />follows: <br />ANA T.YSTA <br />1. Property Size: 4 acres <br />2. Zoning Classification: RS -6, Residential Single Family <br />Zoning District (up to 6 units/acre) <br />3. Land Use Designation: LD=2, Low Density Residential (allow- <br />ing up to 6 units/acre) <br />4. Existing Use: Currently single family, the owner -states that <br />the site had been used to privately house horses until May of <br />1985. The site is heavily wooded. <br />5. Ordinance requirements for noncommercial stables (Sec. <br />25.1 (a) (9)) : <br />a) Noncommercial stables shall be allowed in nonagri- <br />cultural districts only as an accessory use. <br />b) Such uses shall be located on lots having an area of no <br />less than two (2) acres. <br />c) The number of horses shall not exceed one per acre. <br />d) There shall be a minimum setback of fifty (50) feet from <br />any property lines. <br />e) The applicant shall provide a fence which has a minimum <br />height of four (4) feet and totally encloses the area. <br />6.
