Miller MXM SINGLE-FAMILY LOTS <br />Chief, Current Development <br />FROM: Stan Boling ,,4,,6, REFERENCES: stormwater Discharge <br />Staff Planner STAN3 <br />It is requested that the following information be given formal <br />consideration by the Board of County Commissioners at their <br />regular meeting of May 21, 1986. <br />DESCRIPTION & CONDITIONS: <br />At their October 31, 1985 public joint meeting, the Board of <br />County Commissioners and the Planning & Zoning Commission reviewed <br />and discussed a proposal to amend the Zoning Code to regulate <br />stormwater discharge from single-family lots. After consideration <br />of the proposal, the Board of County Commissioners directed staff <br />to advertise public hearings of the -Commission and the Board for <br />the adoption of the proposed amendment. <br />Staff has prepared the amendment, incorporating a change suggested <br />by the Board and Commission at the October 31st meeting, and <br />including more specific criteria by which the Public Works <br />Director will determine approval/disapproval of required con- <br />ceptual drainage plans. At their regular meeting of February 13, <br />1986 the Planning & Zoning Commission voted 3 to 0 to recommend to <br />the County Commission that the proposed amendment to regulate <br />stormwater discharge from single-family lots be adopted. At a <br />February 20th joint workshop, the Planning & Zoning Commission <br />asked and received permission from the Board of County Commis- <br />sioners to workshop the proposed amendment prior to formal Board <br />consideration. An advertised and noticed workshop was held on <br />April 18, 1986. The conclusion of the workshop was to bring the <br />ordinance before the Board of County Commissioners for adoption. <br />ALTERNATIVES & ANALYSIS: <br />The County via complaints from homeowners adjacent to newly <br />constructed homes, has recognized the need to address drainage <br />problems on single-family lots for which no subdivision positive <br />stormwater system has been provided or constructed. Drainage <br />problems usually occur when newer houses are built in older <br />subdivisions two to four feet higher than existing adjacent homes. <br />Disparities in floor elevations of newer and older homes have <br />increased in the last year. State regulations adopted in February <br />of 1985 now require that septic tanks and drainfields be 12" <br />higher above the wet season water table than previously required. <br />In some areas, newer flood insurance requirements can cause <br />disparities in building pad elevations as well. <br />The proposed ordinance would address these problems by requiring <br />approval of conceptual drainage plans as part of the normal <br />building permit review for single-family home construction on <br />certain single -;Family lots or parcels. The drainage plan would be <br />included in the building plot plan or parcel survey. Much of the <br />information required on the plan is already provided in septic <br />tank permit applications. The ordinance would also require that <br />any drainage improvements shown on an approved conceptual plan <br />shall be provided, constructed and inspected prior to the issuance <br />of a Certificate of Occupancy for the residence. <br />51 <br />MAY 2 ] 1966 <br />BOOK ' CA,t 5" <br />
